Uber, Lyft pay $328 million for “cheating drivers” out of earnings, NY says::Wrong deductions “withheld hard-earned pay from drivers,” NY AG says.
How big is the actual scam if you’re settling for $0.32B?
How does sick pay work for gig drivers? I’m not trolling, I’m asking out of ignorance. They basically show up for work whenever they have the time to, and Uber gives them passengers to pick up when they do, right? When they’re sick they simply don’t log in that day.
Does sick time pay accumulate, and then drivers are allowed to claim it during a day or week when they dont work as many hours as they usually do?
My uneducated guess with zero research into this topic: gig drivers are considered “self employed” and have no employer coverage for time off. They get paid when they work. They don’t when they don’t.
Happy to be corrected and educated if wrong.
At least in the UK Supreme Court ruled that uber drivers are not self-employed and thus have all the normal protections you would expect. And it seems they have insurance for various things including for sickness or injury leading to more than 7 consecutive days of inability to work.
In the US, probably more along the lines of just don’t get sick.
Nice. Thanks for sharing this info.
The article says NY State drivers now get sick time and I am ignorant as to how workers with no set work schedule can get sick time. But it’s obviously a thing now, since it was part of this settlement.
This is the best summary I could come up with:
The AG’s announcement has quotes from several New York Taxi Workers Alliance members, including Malang Gassama, a former driver for Uber and Lyft.
“I’ve calculated that Uber and Lyft took at least $25,000 from my pay that they shouldn’t have in the form of sales tax and the Black Car Fund surcharge,” Gassama is quoted as saying.
Uber said the settlement "helps put to rest the classification issue in New York and moves us forward with a model that reflects the way people are increasingly choosing to work.
It also will serve as a model for other states, demonstrating that when we work together with legislators and regulators, we can resolve these issues in a way that benefits workers and consumers alike."
“New York is the first state in the country with which Uber has agreed to a settlement that addresses both past and future unemployment insurance liability,” Gov.
It “builds on the benefits and protections that drivers already enjoy through the state’s Black Car Fund, which provides accident disability and workers’ compensation, dental and vision coverage, telemedicine services, and more,” Lyft said.
